The United States Supreme Court has ruled 5-4 to keep a Trump-era border policy in place.
Title 42 was enacted by the Trump administration to slow the spread of COVID-19 by allowing authorities to expel migrants at the U.S. border immediately.
The Court will hear a challenge by 19 Republican state attorney generals seeking to prevent the Biden White House from lifting the controversial policy.
Conservative Justice Neil Gorsuch joined the Court's liberal wing in opposing the GOP-led states' request to end the policy.
The intervention comes as Republicans and some Democrats have warned about repealing Title 42. Lifting the policy would likely lead to a massive migrant surge.
Even California Gov. Gavin Newsom predicted that migrants seeking asylum would end up on the streets while their claims take years to process. In an television interview earlier this month, the governor warned, โThe fact is, what we've got right now is not working and is about to break in a post-42 world unless we take some responsibility and ownership.โ
American Liberty News reported at the time on Newsom's cautionary advice:
โWe're already at capacity at nine of our sites,โ Newsom continued. โWe can't continue to fund all of these sites because of the budgetary pressures now being placed on this state and the offsetting issues that I have to address.โฆ The reality is, unless we're doing what we're doing, people will end up on the streets.โ

Fox Newsย reports that roughly 22% ofย California's 11 million immigrants are in the country illegally. Earlier this fall, Newsom signed a bill allowing illegal immigrantsย to obtain state ID, saying, โWe're a state of refuge โ a majority-minority state, where 27% of us are immigrants.โ
