Alec Baldwin's attorneys have notched another win before his involuntary manslaughter trial.
Forcing the case's special prosecutor to recuse herself.
Lawyers for Baldwin argued that Andrea Reeb's appointment as special prosecutor in the โRustโ movie set shooting violated the New Mexico constitution because she's also a state legislator.
The New York Times further reports:
It was the second recent setback for the prosecution. Last month prosecutorsย downgraded the charges Baldwin facedย in the killing of the cinematographer, Halyna Hutchins, after his lawyers argued that the Santa Fe County district attorney had erred by initially charging him underย a law that was not passed until months after the shooting.
The special prosecutor, Andrea Reeb, was appointed last year by District Attorney Mary Carmack-Altwies, who hadย asked state officials for additional fundingย to hire employees to prosecute the case. At the time, Ms. Reeb had been campaigning for a seat in the state's House of Representatives as the Republican candidate; she won the election months later and continued in the position of special prosecutor.
โAfter much reflection, I have made the difficult decision to step down as special prosecutor in the โRust' case,โ Ms. Reeb, a former district attorney, said in a statement on Tuesday. โMy priority in this case โ and in every case I've prosecuted in my 25-year career โ has been justice for the victim. However, it has become clear that the best way I can ensure justice is served in this case is to step down so that the prosecution can focus on the evidence and the facts, which clearly show a complete disregard for basic safety protocols led to the death of Halyna Hutchins.โ
A spokeswoman for the district attorney's office, Heather Brewer, declined to comment on whether a new special prosecutor would be appointed.
Baldwin's lawyers challenged Reeb's appointment last month, arguing her dual roles as a prosecutor and lawmaker were unlawful because they combined โtwo core powers of different branches โ legislating and prosecuting โ in the same person and is thus barred by the plain language of Article III of the New Mexico Constitution.โ
American Liberty News reported last month on the Santa Fe County's District Attorney's Office's decision to drop a firearm enhancement charge on one of the two manslaughter charges against Baldwin and the film's armorer Hannah Gutierrez-Reed:
The decision comes after lawyers for Baldwin andย Hannah Gutierrez-Reed, the armorer who supervised Baldwin's gun, filed a motion that prosecutors incorrectly charged the defendants under a state law that passed afterย Halyna Hutchins'ย death on the set of the movie โRust.โ
With the changes to the original charges, Baldwin and Gutierrez-Reed face a maximum sentence of 18 months, a dramatic reduction from a possible five-year prison sentence.
โRustโ is scheduled to resume filming with a mix of new and old crew members this spring.

Remember that this case is one of Hollywood Leftism V. the American Justice system. As demonstrated by Baldwin’s early public and absurd denials, Liberals have no moral restraint, no reservations about lying, and certainly about corrupting, bribing, or intimidating their way to achieving their ends.
