Is Manhattan District Attorney Alvin Braggโs case against Donald Trump done for?
Harvard Law professor emeritusย Alan Dershowitz speculated DA Bragg's possible criminal case against the former president derailed after former federal prosecutor Robert Costello's testimony.
Dershowitz appeared on Fox News on Tuesday night and told host Sean Hannity that โBob Costello has changed this case dramatically.โ
โI think that Bragg now only has two possible results from that. Number one, he can say, โalright, I'm going to try to make the case without Cohen.' He cannot use Cohen as a witness anymore. That would be unethical because of the testimony that Costello gave,โ Dershowitz said. โOr he could say, โlook, I have to drop the case.' He may not be able to make it without Cohen. But if he can't make it without Cohen, he can't make it, because no ethical prosecutor is allowed to put on as a witness somebody who has told the lies and has contradicted himself so much.โ
Dershowitz said that Costello's testimony has, at the very least, slowed Bragg's movement toward any potential indictment, if not halted it completely.
โI think that Bob Costello โ it's a game changer. I think maybe that's a reason for the delay here. I think ethical experts are now telling Bragg, โwait a minute, you cannot use Cohen,'โ said Dershowitz. โBut if you can't make it without Cohen, you cannot bring this charge.โ
On Monday Costello testified to the grand jury that Cohen said that the hush money payments were his idea, not Trump's.
โThey seemed clearly one-sided and not after the truth,โ Costello toldย The New York Timesย afterward.
As American Liberty News previously reported, prosecutors are expected to charge Trump with a felony by arguing that the alleged crime was committed to hide an illegal campaign contribution. The potential problem for Trump centers around how his company reimbursed former attorneyย Michael Cohen, who pleaded guilty to related charges and served time in prison.
The payment to Daniels was listed as a legal expense and Trump's company cited a retainer agreement with Cohen. The retainer agreement did not exist and the reimbursement was not related to any legal services from Cohen, thus setting up a potential misdemeanor criminal charge of falsifying business records. A report by NBC News said that Trump personally signed several of the checks to Cohen while he was serving as president.
Cohen reportedly turned to Costello for legal advice as federal authorities began investigating the payment.ย In August 2018, Cohen pleaded guilty to eight charges involving tax evasion, fraud, and campaign finance violations related to the payment
Prosecutors can elevate the misdemeanor to a felony if they can prove that Trump's โโintent to defraud' included an intent to commit or conceal a second crime.โ
Prosecutors argue that the second crime is that the $130,000 hush payment was an improper donation to the Trump campaign because the money was used to stop a story for the purpose of benefiting his presidential campaign.

Cohen served jail time for what he was giving testimony to that dufus Bragg. Bragg had to know this but they wanted the perp walk for political gain.
