In order toย bolster his case against Hillary Clintonย and the Democratic National Committee (DNC) in the investigation of the discredited Steele โRussia Collusion' Dossier used to smear former President Donald Trump, Special Counsel John Durham hasย alerted the judge presiding over the case against a formerย Clinton campaign lawyer that Hillary and the DNC likely violated campaign laws.
This, in order to show that they are lying about the opposition research firm Fusion GPS (Fusion) doing legal work for them, hence having legal โprivilege' to keep them from disclosing documents relating to their conspiracy to smear Trump.
The Epoch Times (ET)ย notesย that: โFusion's services included helping create the dossier compiled by ex-British spy Christopher Steele. The dossier's allegations against Trump, which were salacious and unsubstantiated, were promoted heavily by the Clinton campaign and Democrats in their bid to get Clinton elected and, later, to impeach Trump.โ
While not admitting wrongdoing, both the DNC and Clinton campaign paid fines and entered into conciliation agreements with the Federal Election Commission (FEC) over false reporting of payments.
Durham argues that this helps show that Fusion did not provide legal services to the other parties, rendering their privilege claims moot, and is using the FEC's findings to support his position.
As Iย wrote about earlier, Durham is prosecuting Michael Sussman, a Clinton campaign lawyer who also represented the DNC, who brought unverified information that falsely showed a fictitious secret backchannel between the Trump Organization and a Russian bank leading up to the 2016 election.
According to Durham, Sussmann lied when he told an FBI lawyer that he was not bringing the incriminatingย information on behalf of a client. (RELATED: Durham Shares New Evidence Possibly Incriminating Clinton Lawyer)

Durham filed the Federal Election Commission (FEC) and conciliation agreements that the campaign and the DNC entered into with the FEC along with paying the fines for whatย the FEC describedย as probable violations of laws governing the reporting of political entity disbursements.

At issue is the Democrat entities' ties to Fusion GPS, a firm that specializes in opposition research.
The entities primarily paid Fusion GPS through a law firm they tapped, Perkins Coie.
The payments were described as for legal services but actually went toย Fusion to perform opposition research on former President Donald Trump, at the time Clinton's rival for the presidency.
โSpecifically, the FEC found โprobable cause to believe' that the DNC and [the Clinton campaign] improperly reported their payments to Perkins Coie for Fusion GPS's opposition research as โlegal and compliance consulting,'โ Durham told U.S. District Judge Christopher Cooper, an Obama appointee, in the new filing.
ET adds that in his filing to the judge, Durham attached the FEC documents to a motion to compel the Clinton campaign, the DNC, Fusion and Perkins to produce the documents they are withholding as โattorney-client communicationsโ or other โprivilegedโ material.
