The Department of Justice (DOJ) is suing Texas and Gov. Greg Abbott (R) over his Rio Grande barrier after the Republican chief executive vowed to fight DOJ requests to take it down.
Hours before, Abbott warned the Biden administration it would โface the consequencesโ if it took the Lone Star State to court.
โThe tragic humanitarian crisis on the border was created because of Biden's refusal to secure the border,โ the governor wrote in a statement.

ABC News has more on the lawsuit over the buoys intended to keep migrants from illegally crossing into the U.S.:
The DOJ on Friday had warned Abbott about his administration's use of the ballards.
โThe State of Texas's actions violate federal law, raise humanitarian concerns, present serious risks to public safety and the environment, and may interfere with the federal government's ability to carry out its official duties,โ read the letter, obtained by ABC News.
Last week, Abbott had the ballards installed in the river in an effort to deter migrants from crossing.
โTexas's unauthorized construction of the floating barrier is a prima facie violation of the Rivers and Harbors Act. This floating barrier poses a risk to navigation, as well as public safety, in the Rio Grande River, and it presents humanitarian concerns,โ the Justice Department's Friday letter stated. โThus, we intend to seek appropriate legal remedies, which may include seeking injunctive relief requiring the removal of obstructions or other structures in the Rio Grande River.โ
Abbott contends that Texas has authority under the state constitution and the U.S. Constitution to defend its borders after the White House's failure to do so.

Individuals involved in filing this lawsuit should be fined heavily for filing a frivilous lawsuit and wasting the courts precious time and resources.
Every red state Attorney General should send letters to the DOJ supporting Texas for using their fully legal right to protect their territorial sovereignty that every state still maintains. Voluntarily joining the republic did not in any way revoke their right to territorial sovereignty. This is why the Tenth Amendment exists. The federal entity is supposed to be responsible for protecting states territory from foreign invaders but if the federal entity fails or refuses the governor of the state has the authority to do what needs to be done.
